DBE certification lets your firm count toward Disadvantaged Business Enterprise goals on federally funded highway, transit and airport contracts. The rules changed: every owner must now prove disadvantage individually. What changed for DBE certification
- No more presumption. Since the U.S. Department of Transportation’s interim final rule of October 2025, race and sex no longer create a presumption of disadvantage.
- Final rule published September 25, 2026. It keeps the individualized standard and sets deadlines for reevaluating existing DBEs.
- A personal narrative with objective evidence. Each disadvantaged owner must describe specific economic hardship, barriers or denied opportunities, tied to at least one objective factor.
- Economic disadvantage in fact. Certifiers still apply the personal net worth cap and can deny an owner who is not economically disadvantaged compared with similarly qualified people.
- Existing DBEs are being reevaluated. Certifying agencies must finish reevaluations by December 24, 2026, with one possible 90-day extension. Firms that do not provide documents by March 24, 2027 lose eligibility.

Who qualifies for DBE certification
- The firm is at least 51% owned and controlled by one or more individuals who are socially and economically disadvantaged under the individualized standard
- Each disadvantaged owner’s personal net worth is under the DBE cap
- The firm is small under SBA size standards and DOT’s gross receipts limit
- The disadvantaged owners control day-to-day operations and long-term decisions
- The firm is an independent business, not reliant on another firm’s staff or equipment

Can I still apply for DBE certification?
Yes. Caltrans and other certifiers are accepting applications under the individualized standard. You must show disadvantage with a personal narrative and evidence instead of relying on group membership.
I am already a DBE. What do I need to do?
Respond to your certifier’s reevaluation request with a personal narrative and a current personal net worth statement. Firms that do not provide documents by March 24, 2027 lose eligibility. See our DBE reevaluation service.
What is the difference between DBE and SBE or SB certification?
DBE is the federal DOT program for transportation contracts. SBE programs are run by local agencies, and California SB certification is a state program. Many firms hold more than one.
Is there a fee to apply for DBE certification?
Certifiers generally charge no application fee. GERC charges only for preparing and managing your application.
Where do I apply in California?
Through the Caltrans DBE certification system, which serves the California Unified Certification Program. One certification is recognized by all DOT-funded agencies in the state.
Can a woman-owned or minority-owned firm still qualify?
Yes, if each disadvantaged owner can show individual social and economic disadvantage under the new standard. Group membership alone no longer qualifies.
