Caltrans DBE Reevaluation: Keep Your Certification and Your Contracts

Short answer: Every certified DBE in California is going through the Caltrans DBE reevaluation required by the federal rule issued on October 3, 2025. To keep your certification, each disadvantaged owner now has to prove disadvantage individually, with a personal narrative and a current Personal Net Worth statement. Caltrans’ deadline was April 16, 2026. If you missed it, you can still file: late packets are reviewed after on-time ones.

What this means for your contracts

Your DBE certification is part of why primes put you on their bid lists for Caltrans, transit and airport work. Right now that pipeline is disrupted. While reevaluation runs, Caltrans says agencies cannot set DBE contract goals or count DBE participation toward them, and new DBE applications are paused.

Two things protect your work in the meantime:

  • Get through reevaluation, so you are still certified when DBE goals return. Firms that do not meet the new standard can be decertified.
  • Add state certification now. California SB, SB-PW and DVBE are not affected by the federal rule and still count toward state participation goals today. We hold SB (Micro) and SB-PW certification ourselves, and we prepare SB and SB-PW and DVBE certification for clients.

A personal narrative is evidence, not an essay

The rule no longer presumes disadvantage based on race, ethnicity or gender. Caltrans asks for specific instances of economic hardship, systemic barriers and denied opportunities that the owner personally experienced. Broad statements about an industry or a group do not meet that standard. What does: a date, who was involved, what happened, what it cost, and a document that shows it.

For contractors and engineering firms, that evidence usually sits in places like these:

  • Loan, credit line or bonding applications that were refused, or approved on worse terms
  • Bids and subcontracts lost in circumstances you can document
  • Payment terms or delays imposed on you that others did not face
  • Barriers in education, hiring or licensing earlier in your career
  • The effect on revenue, bonding capacity and growth, shown in figures

  1. Free 15-minute assessment. Where your packet stands, what Caltrans has asked for, and whether we can realistically help. If you do not need us, we will tell you.
  2. Owner interview. A structured session with each disadvantaged owner to bring out specific incidents, dates and records.
  3. Evidence list. We tell you exactly which documents to pull: letters, emails, loan decisions, bid results, tax returns.
  4. Narrative and net worth statement. We draft, you review every line, and we assemble the Personal Net Worth statement with supporting statements that match its “as of” date.
  5. Submission and follow-up. We answer Caltrans’ requests for information and keep a complete record in case of appeal.
  6. State certification in parallel. Where you qualify, we file SB, SB-PW or DVBE so you keep bidding while the federal side settles.

What goes into a DBE personal narrative?

Specific instances of economic hardship, systemic barriers and denied opportunities the owner personally experienced, with dates, amounts and supporting documents. General statements about an industry or group are not enough.

What are the DBE requirements for construction firms now?

The disadvantaged owners must own at least 51% of the firm and control it day to day, each must have a personal net worth below $2,047,000 (excluding primary residence equity, retirement funds and their interest in the firm), and the firm must be a small business. Since October 2025, each owner must also show individual social and economic disadvantage in a personal narrative.

I missed the April 16, 2026 deadline. What now?

Caltrans still accepts late packets but reviews them after on-time submissions, and your firm cannot take part in the DBE program until it is approved. File as soon as you can.

My firm was decertified. Can I appeal?

You have 45 days from the decision letter to appeal to USDOT. Appeals are decided on the existing record, so the original packet matters. We prepare the record and work with your attorney on the appeal itself.

How long does it take to get DBE certified in California?

Right now Caltrans has paused new DBE applications until the reevaluation is complete. California SB, SB-PW and DVBE certifications are still open, and DGS does not charge to apply.

Can I still win public work while my reevaluation is pending?

Yes. State-funded work does not depend on DBE status. California SB, SB-PW and DVBE certifications count toward state participation goals now, and primes bidding state work look for certified subcontractors.
