Engineering and construction firms face four separate gates before they can bid California public works, and they are administered by three different agencies. You need SB-PW certification from DGS for the bid preference, DIR registration at $400 a year to be legally eligible at all, certified payroll reporting once you are on site, and apprenticeship compliance on any contract of $30,000 or more. GERC handles all four.
Why construction is treated differently
Standard California Small Business certification caps at $19 million in average gross receipts and 100 employees. That threshold makes little sense for a contractor, whose receipts include materials, equipment and subcontractor payments passing straight through. A genuinely small firm with twenty people on the books can clear $19 million on paper.
So the state created SB-PW — Small Business for the Purpose of Public Works — at $46 million and 200 employees, applicable to public works only. If you qualify for standard SB, take that instead, because it covers public works and everything else. If you do not, SB-PW is how you get the 5% bid preference.
The four gates, in order
- SB-PW or SB certification (DGS). Free to apply, 30 to 45 days from a complete application, valid two years. This is what gives you the 5% bid preference and access to the state’s 25% small business participation target.
- DIR public works contractor registration. $400 annually and non-refundable. Required for every contractor and subcontractor intending to bid or perform public works. Awarding bodies cannot accept a bid that lists an unregistered contractor or subcontractor.
- Certified payroll records. Submitted to the Labor Commissioner for all public works projects, unless exempt under the small project thresholds of $25,000 for construction or $15,000 for maintenance.
- Apprenticeship compliance. Triggered on contracts of $30,000 or more. DAS 140 to the apprenticeship committees, DAS 142 at least three business days before apprentices are needed, one hour of apprentice work for every five journeyman hours, plus training fund contributions.
Miss the second one and your bid is rejected before anyone reads it. Miss the third or fourth and you are exposed to penalties and withheld payment on a job you have already done.

What is SB-PW certification?
Small Business for the Purpose of Public Works. It allows average annual gross receipts up to $46 million and 200 employees, against $19 million and 100 for standard Small Business certification, but applies only to public works contracts.
Should a contractor certify as SB or SB-PW?
If you fall under the standard thresholds of $19 million and 100 employees, take standard SB, because it covers public works and everything else. SB-PW exists for firms whose receipts exceed that because of pass-through material and subcontractor costs.
How much does DIR registration cost?
$400 per year, and it is non-refundable. Every contractor and subcontractor intending to bid or perform public works in California must be registered.
Can I bid public works without DIR registration?
No. Awarding bodies cannot accept a bid that lists an unregistered contractor or subcontractor. This has been in effect since March 2015.
Do I have to submit certified payroll on every job?
On public works projects, yes, to the Labor Commissioner, unless the project falls under the small project exemption of $25,000 for construction or $15,000 for maintenance.
When do apprenticeship requirements apply?
On contracts of $30,000 or more. You file DAS 140 with the apprenticeship committees, DAS 142 at least three business days before apprentices are needed, and must employ one hour of apprentice work for every five journeyman hours.
Is SB-PW certification free?
