DVBE Certification in California: Requirements and How to Apply

California sets an annual participation goal for Disabled Veteran Business Enterprises on state contracts. For a veteran-owned firm, DVBE certification is the difference between competing against everyone and competing inside a protected pool.

The requirements are specific, and one of them catches LLC owners off guard.

Who qualifies

Ownership

For corporations and partnerships, the business must be at least 51% owned by a disabled veteran.

For limited liability companies, the standard is stricter: one or more disabled veterans must own 100%. An LLC with a non-veteran partner holding any share does not qualify. This surprises people every year, and it is worth confirming before you assemble an application.

Disability rating

At least a 10% service-connected disability rating, as stated in the Award of Entitlement letter from the VA.

Residency

The disabled veteran owner must be domiciled in California. The business itself may operate elsewhere, but the home office must be in the United States — a foreign subsidiary does not qualify.

Management and control

A disabled veteran must manage and control day-to-day operations and the overall direction of the business. Passive ownership is not enough. The owner and the manager can be two different disabled veterans, though usually one person fills both roles.

Documents you will need

  • Award of Entitlement letter — and this is the one that trips up applications: it must be dated within six months of your application. An older letter, even for a permanent rating, will not be accepted. Request a current one from the VA before you start.
  • Federal tax returns — California law requires these to verify disabled veteran ownership.
  • Formation and ownership documents supporting the ownership percentages above.

How to apply

  2. Request a current Award of Entitlement letter from the VA, if yours is older than six months.
  3. Complete the DVBE application within Cal eProcure and upload supporting documents.
  4. Submit and wait for review by the DGS Office of Small Business and DVBE Services.

DVBE certification lasts two years

Unlike some certifications, DVBE runs on a two-year term, renewable online through Cal eProcure. Diary the expiration date. A lapsed certification removes you from the DVBE pool at exactly the moment an agency is looking to meet its participation goal.

Should you also get SB certified?

Usually yes. They are separate certifications serving separate preferences, and many firms hold both. California Small Business certification requires a principal office in California, under 100 employees including affiliates, and average gross annual receipts at or under $16 million — with a higher threshold for the public works variant. Holding SB and DVBE together makes you responsive to the widest range of state solicitations.
