Short answer: For most California contractors in 2026, SB-PW certification is the one that pays right now. It gives a 5% bid preference on state solicitations (capped at $50,000 per bid), it counts toward the state’s 25% small business participation goal, and applications are open. DBE certification matters for federally funded transportation work such as Caltrans federal-aid projects, transit and airports, but in California new DBE applications are paused, and while the reevaluation runs, agencies cannot set DBE goals or count DBE participation. If you qualify for both, hold both.

Which one fits the work you bid
- You mostly bid state agency jobs. SB-PW. The preference and the 25% goal apply to state contracting, including construction of state facilities.
- You work on federal-aid roads, transit or airports. DBE is the certification those contract goals are written for. Stay certified through the reevaluation so you are ready when goals return, and add SB-PW for state work in the meantime.
- You mostly bid city, county and school district jobs. Be realistic: most local public works go to the lowest responsible bidder, and the state preference does not apply there. Some local agencies run their own small business programs with separate certification, so check each agency. Certification still helps you get onto primes’ bid lists.
- You work as a subcontractor. Both help. Primes on state jobs look for certified small businesses, and primes on federal-aid jobs look for DBEs.
Why SB-PW pays right now
The 5% preference is applied to the evaluation, not your price. Say the lowest bid from a non-small firm is $600,000. Five percent of that is $30,000, so a certified small business bidding under $630,000 is evaluated as the low bidder and can win at its own price. On bigger jobs the $50,000 cap takes over: above $1 million in low bid, the most the preference can close is $50,000.
SB-PW exists because construction receipts include materials, equipment and subcontractor payments that pass straight through. A firm with twenty people can clear the standard $19 million SB limit on paper, so SB-PW allows up to $46 million and 200 employees, for public works only. Where DBE still matters
DBE is how federally assisted transportation contracts meet their participation goals, and those contracts are a large share of heavy civil and road work. The program changed under the October 3, 2025 federal rule: every owner now has to show disadvantage individually, and California is reevaluating every certified firm. If you are already a DBE, the certification is worth keeping. A decertified firm has to start again once applications reopen. Can you hold both?
Yes, if you meet both sets of rules. They test different things: SB-PW looks at size and California residence; DBE looks at size, personal net worth and individual disadvantage. A firm small enough for DBE is usually within the SB-PW size limits too; the extra SB-PW tests are a California principal office and California-domiciled owners. If a disabled veteran owns the firm, DVBE certification adds a third route, since state agencies have a 3% DVBE goal.

- Not certified at all: start with SB-PW, or standard SB if you are under $19 million and 100 employees. It is free, it is open, and it takes weeks, not months.
